Hong Kong Regulatory Framework
As a precious metals dealer, we are subject to Hong Kong's regulatory framework, including:
- Dealer in Precious Metals and Stones (DPMs) Registration: We have completed the registration process with the Hong Kong Customs and Excise Department under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615) (AMLO). Our registration number is [to be inserted once available]. We adhere to the Code of Practice for Dealers in Precious Metals and Stones issued by the Hong Kong Customs and Excise Department.
- Anti-Money Laundering (AML) and Counter-Terrorist Financing (CFT): We maintain a robust AML/CFT program that includes:
- Comprehensive Customer Due Diligence (CDD) procedures to verify the identity of our customers.
- Enhanced Due Diligence (EDD) for high-risk customers, such as Politically Exposed Persons (PEPs) and customers from high-risk jurisdictions.
- Ongoing monitoring of customer transactions to detect and report suspicious activities.
- Timely reporting of suspicious transactions to the Joint Financial Intelligence Unit (JFIU).
- Maintenance of accurate records for a minimum of five years, as required by law.
- Regular training for our staff on AML/CFT requirements to ensure awareness and compliance.
- Data Protection: We are committed to protecting the personal data of our customers in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) (PDPO). Our data protection practices include:
- Collecting only necessary personal data for the purposes of our business and legal obligations.
- Implementing appropriate technical and organizational measures to safeguard personal data against unauthorized access, loss, or theft.
- Providing customers with access to their personal data and the right to correct inaccuracies, as per their rights under the PDPO.
- Ensuring that any cross-border transfers of personal data are conducted in compliance with applicable laws.
- Other Regulatory Obligations: We also comply with other Hong Kong laws and regulations relevant to our business, including but not limited to:
- The Companies Ordinance (Cap. 622)
- The Business Registration Ordinance (Cap. 310)
- Taxation laws and regulations administered by the Inland Revenue Department (IRD)
International Compliance
As a global business, we are also mindful of international regulatory standards and ensure that our operations meet the expectations of our international customers. This includes:
- Adherence to international sanctions regimes, such as those imposed by the United Nations, the United States, and the European Union.
- Compliance with anti-bribery and corruption laws, including the Prevention of Bribery Ordinance (Cap. 201) in Hong Kong and the Foreign Corrupt Practices Act (FCPA) in the United States.
- Commitment to ethical business practices and corporate social responsibility.
- Alignment with the recommendations of the Financial Action Task Force (FATF) on combating money laundering and terrorist financing.
Reporting Obligations
We maintain reporting obligations to various authorities:
- Joint Financial Intelligence Unit (JFIU): Submission of suspicious transaction reports (STRs) as required under AMLO.
- Hong Kong Customs and Excise Department: Compliance reporting as a registered DPMs.
- Privacy Commissioner for Personal Data (PCPD): Notification of any personal data breaches, as required under PDPO.
- Inland Revenue Department (IRD): Filing of tax returns and compliance with tax laws.
